General Terms and Conditions

Effective Date: Feb 2, 2026

These General Terms and Conditions (“Terms”) govern all services provided by Mighty Junk Removal LLC, a New Mexico limited liability company (“Company,” “we,” “us,” or “our”), including but not limited to dumpster rentals, junk removal, demolition services, and related labor or hauling services (“Services”).

By scheduling, authorizing, or paying for any Services, Customer agrees to be bound by these Terms.


1. Acceptance of Agreement

By booking Services online, over the phone, in person, or by electronic signature, Customer agrees to these Terms in full.

Electronic signatures, online checkboxes, SMS confirmations, invoices, and payment submissions constitute legally binding acceptance.

If Customer does not agree, Services must not be scheduled or used.


2. Strict No-Refund Policy

ALL SALES ARE FINAL.

Mighty Junk Removal LLC maintains a strict no-refund policy consistent with payment processor (including Stripe) standards.


No refunds will be issued for:

  • Early completion of service
  • Unused rental time
  • Overestimation or underutilization
  • Customer scheduling conflicts
  • Permit or HOA issues
  • Weather delays
  • Change of mind
  • Denied access to property
  • Scope misunderstandings


If a cancellation is approved prior to service dispatch, Company may apply a cancellation fee at its discretion.

Once equipment is dispatched or crew is assigned, charges are non-refundable.


Initiating a chargeback or payment dispute for valid charges constitutes material breach of this Agreement. Customer agrees to pay all collection costs, legal fees, and dispute processing fees incurred by Company.


3. Payment Authorization

By providing payment information, Customer:

Authorizes Mighty Junk Removal LLC to charge the provided payment method for all agreed service fees.

Authorizes additional charges for overweight fees, labor overages, extension days, disposal surcharges, prohibited materials, trip fees, damages, and any balance due.


Authorizes charges for up to 120 days after service completion for adjustments or discovered fees.

Revoking payment authorization before final balance is resolved constitutes breach of contract.


4. Estimates and Pricing

Quotes provided are estimates unless explicitly stated as fixed-price in writing.

Final charges may vary due to:

  • Increased volume or weight
  • Additional labor time
  • Restricted access
  • Hidden materials
  • Hazardous materials
  • Permit requirements
  • Customer-requested changes

Customer agrees to pay reasonable additional charges incurred.


5. Property Access and Right of Entry

Customer grants Mighty Junk Removal LLC permission to enter the property for purposes of delivering equipment, performing services, demolition, hauling, inspection, and retrieval.


Customer confirms they are the property owner or authorized agent

Company is not responsible for delays or additional costs caused by denied or restricted access.


6. Surface and Property Risk Acknowledgment

Customer understands that Services may involve heavy equipment, vehicles, dumpsters, debris movement, and structural removal


Customer assumes risk for:

  • Driveway cracks or depressions
  • Asphalt damage
  • Concrete stress fractures
  • Paver shifting
  • Lawn or landscaping damage
  • Underground utilities
  • Sprinkler systems
  • Septic systems
  • Private utility lines
  • Interior floor scratches (for removal services)

Company is not responsible for damage resulting from normal service operations.


7. Photo and Video Documentation

Customer authorizes Company to photograph and video record:

  • Property conditions before and after service
  • Placement areas
  • Materials removed
  • Jobsite conditions

Documentation may be used for dispute resolution, insurance protection, internal records, and non-identifying marketing purposes.


8. Prohibited and Hazardous Materials

Customer agrees not to include hazardous, regulated, flammable, explosive, biohazard, or illegal materials in any Services.

If such materials are discovered:

  • Customer is responsible for all disposal costs
  • Environmental penalties
  • Government fines
  • Transport fees
  • Administrative time

Intentional concealment may result in additional penalty charges.


9. Indemnification

Customer agrees to indemnify, defend, and hold harmless Mighty Junk Removal LLC, its owners, employees, contractors, and agents from any claims, damages, liabilities, losses, penalties, fines, attorney fees, or lawsuits arising from:

  • Customer negligence
  • Misrepresentation
  • Failure to obtain permits
  • Structural instability
  • Hidden hazards
  • Third-party injury claims
  • Breach of these Terms


10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

Mighty Junk Removal LLC shall not be liable for:

  • Indirect damages
  • Incidental damages
  • Consequential damages
  • Business interruption
  • Lost profits
  • Project delays

Total liability shall not exceed the amount paid by Customer for the specific service giving rise to the claim.


11. Force Majeure

Company is not liable for delays or failure to perform caused by:

  • Weather
  • Natural disasters
  • Equipment failure
  • Road closures
  • Government orders
  • Labor shortages

Events beyond reasonable control


12. Default and Collections

If payment is not made when due:

  • Account may be sent to collections
  • Customer agrees to pay all collection costs
  • Customer agrees to pay reasonable attorney fees
  • Interest may accrue at the maximum rate allowed by law


13. Dispute Resolution and Governing Law

These Terms shall be governed by the laws of the State of New Mexico.

Any legal action must be brought in a court located in Bernalillo County or Santa Fe County, New Mexico.

Customer waives objections to venue and jurisdiction.


14. Severability

If any provision is found unenforceable, remaining provisions remain fully valid and enforceable.


15. Entire Agreement

These General Terms, together with any service-specific terms and written agreements, constitute the entire agreement between Customer and Mighty Junk Removal LLC.


No modification is valid unless in writing and signed by an authorized representative of the Company.

Dumpster and Equipment Rental Terms

These Dumpster and Equipment Rental Terms (“Rental Terms”) apply to all equipment rented from Mighty Junk Removal LLC (“Company”), including but not limited to:

  • Roll-off dumpsters
  • Roll-off containers
  • Dump trailers
  • Car trailers
  • Equipment trailers
  • Skid steers
  • Mini excavators
  • Compactors
  • Storage containers
  • Temporary fencing
  • Portable restrooms
  • Pressure washers
  • Hand tools (including chainsaws)
  • Company-owned vehicles
  • Any other tools, machinery, trailers, or equipment rented now or in the future (“Equipment”).

These Rental Terms supplement the General Terms and Conditions and apply to all Equipment rentals unless otherwise agreed in writing.

1. Rental Period

The rental period begins upon delivery of Equipment to Customer or upon Customer taking possession, whichever occurs first.

  • Rental duration is defined at booking.
  • Additional days beyond the agreed term may incur daily extension fees.
  • Early return does not entitle Customer to refund.
  • Customer must make Equipment available for retrieval at the scheduled time.
  • Company reserves the right to retrieve Equipment immediately upon rental expiration.


2. Delivery, Placement, and Site Responsibility

Customer is responsible for selecting a safe and legally compliant placement or operating location.

Customer acknowledges that heavy Equipment may cause:

  • Driveway cracks
  • Asphalt depressions
  • Concrete stress fractures
  • Surface scratching
  • Landscaping damage
  • Ground rutting
  • Utility disruption


Company is not responsible for damage caused by normal placement, weight, or operation of Equipment.

Customer assumes risk for:

  • Underground utilities
  • Septic systems
  • Sprinkler systems
  • Private utility lines
  • Ground stability


3. Authorized Use and Operation

Customer agrees that:

Equipment will be used only for its intended purpose.

Only qualified, licensed, and competent individuals will operate machinery and vehicles.

Customer will comply with all local, state, and federal laws.

Equipment will not be subleased, loaned, or transferred.

Customer assumes full responsibility for safe operation.

For vehicles, trailers, skid steers, excavators, pressure washers, chainsaws, and powered equipment:

Customer assumes all operational risk.

Customer is responsible for fuel, fluids, and proper handling unless otherwise agreed.

Customer must verify towing capacity and hitch compatibility for trailers.


4. Weight Limits and Load Requirements (Dumpsters, Containers, and Trailers)

For dumpsters, containers, dump trailers, car trailers, and equipment trailers:

  • Loads must not exceed the top rim or sidewalls.
  • Weight limits specified at booking apply.
  • Overweight charges apply per pound over the included limit.
  • Unsafe or overloaded Equipment must be corrected before transport.
  • Additional trip fees may apply.
  • Weight determinations are based on certified scale tickets where applicable.


5. Prohibited Materials (All Containers & Transport Equipment)

The following are strictly prohibited unless explicitly approved in writing:

  • Hazardous waste
  • Chemicals
  • Asbestos
  • Paints and solvents
  • Batteries
  • Tires (unless pre-approved)
  • Propane tanks
  • Fuel or oil
  • Biohazard materials
  • Explosives
  • Flammable liquids
  • Refrigerants
  • Illegal or regulated materials


If discovered:

  • Customer is responsible for all removal and disposal costs.
  • Environmental penalties and fines will be passed to Customer.
  • Administrative and handling fees may apply.
  • Intentional concealment may result in charges up to 200% of disposal penalties incurred.


6. Portable Restroom Rentals

For portable restrooms:

  • Customer must place units on stable, level ground.
  • Customer is responsible for damage, vandalism, tipping, misuse, or contamination beyond normal use.
  • Units may not be relocated without Company approval.
  • Improper materials placed inside units may result in cleaning or replacement fees.


7. Vehicles and Trailer Rentals

For vehicles, car trailers, and equipment trailers:

  • Customer must possess valid driver’s license.
  • Customer must carry legally required auto insurance.
  • Customer assumes all liability for accidents, traffic violations, towing failures, and third-party claims.
  • Customer is responsible for securing loads properly.
  • Improper towing resulting in damage is Customer’s responsibility.


8. Equipment Condition and Responsibility

Customer accepts Equipment in “AS-IS” condition.

Customer is responsible for:

  • Theft
  • Fire damage
  • Collision damage
  • Rollovers
  • Mechanical abuse
  • Negligence
  • Vandalism
  • Improper storage
  • Unauthorized modifications
  • Repair or replacement costs beyond normal wear and tear will be charged to Customer.
  • Customer assumes responsibility for Equipment from delivery until retrieval.


9. Movement of Equipment

Customer may not relocate, transport, tow, or reposition Equipment without written consent.

  • Unauthorized relocation:
  • Voids liability protections
  • May result in additional fees
  • May result in immediate termination of rental


10. Access for Retrieval

Customer must ensure Equipment is accessible at the scheduled pickup time.

If access is blocked:

  • Dry-run or trip fee may apply.
  • Additional daily rental fees may apply.
  • Customer remains responsible until Equipment is retrieved.


11. Weather and Ground Conditions

Company is not responsible for damage resulting from:

  • Soft soil
  • Mud
  • Frozen ground
  • Surface shifting
  • Weather-related conditions

Customer assumes risk of site conditions.


12. Mechanical Issues and Downtime

For machinery, vehicles, pressure washers, chainsaws, and powered equipment:

  • Company does not guarantee uninterrupted operation.
  • Downtime does not entitle Customer to refund unless Equipment is completely inoperable due to Company negligence.
  • Company may substitute similar equipment at its discretion.


13. Injury and Operational Risk

Customer acknowledges that dumpsters, trailers, machinery, chainsaws, pressure washers, vehicles, and heavy equipment involve inherent risk.

Customer assumes full responsibility for:

  • Personal injury
  • Third-party injury
  • Property damage
  • Improper operation

Company is not responsible for injuries occurring during Customer use.



Junk Removal Specific Terms

These Junk Removal Specific Terms (“Removal Terms”) apply to all labor-based hauling, cleanouts, debris removal, property cleanups, estate cleanouts, construction debris removal, and related services provided by Mighty Junk Removal LLC (“Company”).

These Removal Terms supplement the General Terms and Conditions


1. Scope of Work

Services include removal and hauling of items specifically identified at time of estimate or booking.

Customer agrees that:

  • Only items clearly identified for removal will be removed.
  • Company is not responsible for items left behind unless specifically included in scope.
  • Company is not responsible for accidental removal of items not clearly identified by Customer.
  • Customer must clearly separate items to be removed from items to remain.


2. Estimates and Final Pricing

Quotes are based on visual estimates of:

  • Volume (truck space used)
  • Weight
  • Labor time
  • Accessibility
  • Final price may increase due to:
  • Additional volume
  • Heavier materials than disclosed
  • Limited access (stairs, long carry distance, tight hallways)
  • Disassembly requirements
  • Hazardous or restricted materials
  • Hidden debris

Customer agrees to pay reasonable adjustments if actual job conditions differ from estimate.


3. Access and Safe Work Environment

Customer must provide:

  • Clear and safe access to items
  • Working utilities when required
  • Safe walking paths
  • Pets secured
  • Children supervised


Company reserves the right to refuse or stop service if unsafe conditions exist, including but not limited to:

  • Structural instability
  • Aggressive animals
  • Biohazards
  • Mold contamination
  • Human or animal waste
  • Sharp debris
  • Unsafe hoarding conditions

Charges may still apply if crew is dispatched and cannot complete work due to unsafe conditions.


4. Property Protection and Damage Risk

Customer acknowledges that junk removal involves moving heavy and bulky items through interior and exterior spaces.


Company is not responsible for:

  • Minor wall scuffs
  • Paint scratches
  • Floor scratches
  • Carpet snags
  • Door frame contact
  • Drywall dings
  • Surface abrasions
  • Minor landscaping disturbance

While reasonable care is taken, Customer assumes risk for normal incidental contact during removal operations.

Company is not responsible for pre-existing damage.


5. Structural and Hidden Hazards

Customer represents that:

  • Structures are safe and stable.
  • Floors can support weight of crew and items.
  • No hidden structural damage exists.
  • No concealed hazardous materials are present.


Company is not responsible for damage caused by:

  • Weak flooring
  • Rotten decking
  • Compromised staircases
  • Hidden water damage
  • Termite damage
  • Structural failure

Customer assumes responsibility for structural integrity of the premises.


6. Hazardous and Prohibited Materials

Company does not accept:

  • Asbestos
  • Chemicals
  • Paints and solvents
  • Fuel or oil
  • Biohazard materials
  • Human or animal waste (unless specifically contracted)
  • Sharps or medical waste
  • Illegal materials


If hazardous materials are discovered:

  • Work may stop immediately.
  • Additional fees may apply.
  • Customer is responsible for proper disposal costs.

Intentional concealment may result in additional penalty charges.


7. Donation and Recycling Disclaimer

If Company agrees to donate or recycle items:

  • Acceptance by third-party facilities is not guaranteed.
  • Company is not responsible for condition of donated items.
  • No valuation or tax documentation is guaranteed unless specifically provided.


8. Items of Personal or Sentimental Value

Customer is solely responsible for:

  • Removing cash, jewelry, firearms, documents, collectibles, heirlooms, or sentimental items before service.
  • Inspecting items prior to removal.

Company is not responsible for loss of valuables mistakenly included in removal pile.


9. Weather and Exterior Conditions

Company is not responsible for:

  • Lawn rutting due to soft soil
  • Mud from hauling
  • Weather-related surface impact
  • Wind-blown debris during removal

Customer assumes risk related to site conditions.


10. Abandoned Property

Once items are removed from property and loaded for transport:

  • Ownership transfers to Company.
  • Items will not be returned.

Retrieval requests after removal are not guaranteed and may incur additional fees.


11. Biohazard or Hoarding Conditions

In severe hoarding or contamination environments:

Additional labor and safety fees may apply.

Protective equipment charges may apply.

Work may be limited based on safety assessment.

Company reserves the right to decline extreme or dangerous conditions.



12. Injury and Third-Party Risk

Customer assumes responsibility for:

Injuries to guests or occupants during service.

Ensuring property occupants remain clear of work area.

Company is not responsible for injuries resulting from Customer interference or unsafe conditions.


13. No Refund After Service Completion

Once junk removal services are completed:

All sales are final.

No refunds will be issued.

Disputes over volume or pricing after completion do not entitle Customer to charge reversal.

Initiating a chargeback for valid services constitutes breach of agreement and may result in collections and legal action.

Demolition Specific Terms

These Demolition Specific Terms (“Demolition Terms”) apply to all demolition, tear-out, structural removal, interior demolition, selective demolition, concrete removal, shed demolition, deck removal, fencing removal, and related services provided by Mighty Junk Removal LLC (“Company”).

These Demolition Terms supplement the General Terms and Conditions.


1. Scope of Work

Demolition services include only the work specifically described in the written estimate, invoice, or work order.

Customer acknowledges:

  • Only structures or materials explicitly identified will be demolished or removed.
  • Any additional demolition discovered during the project constitutes a change in scope.
  • Change orders may result in additional charges.

Verbal modifications are not binding unless confirmed by Company.


2. Permits and Regulatory Compliance

Unless explicitly agreed in writing, Customer is responsible for obtaining:

  • Required demolition permits
  • Structural permits
  • Utility disconnect approvals
  • HOA approvals
  • Engineering approvals
  • Environmental clearances

If Company agrees in writing to obtain permits, Customer agrees to reimburse all permit and inspection fees.

Failure to obtain proper permits does not relieve Customer of payment obligations.


3. Utility Disconnection Requirement

Customer must ensure all utilities are properly disconnected before demolition begins, including but not limited to:

  • Electrical service
  • Gas lines
  • Water supply
  • Sewer lines
  • Propane tanks
  • Internet and cable lines

Customer represents that utilities have been properly shut off and made safe.

Company is not responsible for damage resulting from active, hidden, mislabeled, or improperly disconnected utilities.


Any costs associated with emergency response due to undisclosed active utilities are Customer’s responsibility.


4. Structural Integrity and Hidden Conditions

Customer acknowledges that demolition involves inherent risk of:

  • Structural collapse
  • Falling debris
  • Shifting loads
  • Hidden rot
  • Mold
  • Termite damage
  • Compromised framing
  • Water intrusion


Customer represents that structures are safe to enter and work on.

Company is not responsible for:

  • Collapse due to pre-existing structural weakness
  • Hidden structural defects
  • Damage resulting from concealed deterioration

If dangerous structural conditions are discovered, Company may stop work immediately.

Additional charges may apply for hazardous stabilization.


5. Hazardous Materials (Including Asbestos)

Company does not perform licensed asbestos abatement unless explicitly agreed in writing.

Customer represents that no asbestos-containing materials, lead-based paint hazards, or other regulated hazardous materials are present unless disclosed in writing prior to work.

If hazardous materials are discovered:

  • Work will stop immediately.
  • Customer is responsible for testing and remediation.

Customer remains responsible for all charges incurred up to work stoppage.

All environmental fines, penalties, and remediation costs resulting from undisclosed hazardous materials are Customer’s responsibility.


6. Dust, Debris, and Neighbor Impact

Customer acknowledges that demolition generates:

  • Dust
  • Noise
  • Vibrations
  • Debris
  • Equipment traffic
  • Company is not responsible for:
  • Minor dust infiltration
  • Vibration-related cosmetic cracking
  • Noise complaints
  • Temporary access inconvenience
  • Neighbor disputes

Customer agrees to address neighbor concerns and property line disputes.


7. Property and Surface Damage

Customer understands demolition may involve heavy machinery, trailers, dumpsters, and debris removal.

Company is not responsible for:

  • Driveway damage
  • Surface cracking
  • Landscaping disturbance
  • Lawn rutting
  • Fence damage caused by necessary access
  • Minor incidental property contact

Customer assumes risk of ground and surface conditions.


8. Underground Utilities and Unknown Obstructions

Customer is responsible for identifying:

  • Private utility lines
  • Irrigation systems
  • Septic systems
  • Buried tanks
  • Underground wiring
  • Private gas lines


Company is not responsible for damage to unmarked or privately installed underground utilities.

If unknown obstructions are encountered:

  • Work may pause.
  • Additional charges may apply.


9. Salvage and Material Ownership

Unless otherwise agreed:

  • Demolished materials become property of Company.
  • Salvage rights belong to Company.

Requests to retain salvaged materials must be made in writing prior to demolition.


10. Change Orders and Additional Work

If additional demolition is requested or becomes necessary due to unforeseen conditions:

  • Company will issue revised pricing.
  • Customer agrees to pay additional charges.
  • Refusal to approve change orders may result in project suspension


11. Weather and Site Conditions

Company is not responsible for delays caused by:

  • Weather
  • Mud
  • High winds
  • Frozen ground
  • Site instability

Customer assumes risk for ground conditions and access conditions.


12. Injury and Worksite Safety

Customer agrees to:

  • Keep all occupants, guests, and unauthorized individuals clear of the worksite.
  • Maintain a safe perimeter.
  • Company is not responsible for injuries resulting from:
  • Customer interference
  • Third-party access
  • Unsafe property conditions
  • Failure to secure site

Demolition areas are inherently dangerous. Customer assumes risk for unauthorized entry into work zone.


13. Project Delays and Scheduling

Demolition timelines are estimates only.

Company is not liable for:

  • Project delays
  • Construction scheduling conflicts
  • Contractor sequencing issues
  • Permit delays

No refunds or discounts will be issued due to schedule changes outside Company’s control.


14. Finality of Service

Upon completion of demolition services:

  • All sales are final.
  • No refunds will be issued.
  • Disputes over dust, noise, debris, or incidental impact do not entitle Customer to charge reversal.
  • Chargebacks for valid services constitute breach of agreement and may result in collections and legal action.
